Abstract

Abstract：After the uphill battle for “basically overcoming the difficulties in enforcement”，now courts throughout China are faced with the task of establishing a long-term mechanism for the effective solution the difficulties in enforcement. In recent years，the Intermediate People's Court of Ningbo Municipality，by focusing on the epoch topics and adhering to the idea of good-faith and civilized law enforcement，has innovated the enforcement mechanism in light of its actual situations，embedded the idea of good faith into the whole process of handling of enforcement cases，guided the parties in instituting proceedings in good faith，built the case-handling capacity by relying on the grade system，strengthened intelligent enforcement and sunshine enforcement，and creatively established the positive incentive mechanism for voluntary performance of obligation and the credit restoration mechanism. Through these two mechanisms，the court has，in a flexible way，encouraged the parties to abide by the principle of integrity and voluntarily implement their obligations established by court judgments，thereby not only carrying out practical explorations in the comprehensive treatment of the difficulties in enforcement and solving judicial problems at their sources，but also making useful attempts in creating a social atmosphere in which “it is honorable to keep faith and shameful to break faith”，constructing the social credit system，optimizing business environment，and modernizing the system of and capacity for state governance.
